Traffic Safety Bylaw Amendment 943, Amends Traffic Safety Bylaw No. 894, and Impounded Vehicle and Equipment Bylaw No. 944

The City of Iqaluit would like to advise residence of the newly enacted amendment to the City of Iqaluit Traffic Safety Bylaw No. 894, being the amended Traffic Safety Bylaw No. 943. Additionally the City of Iqaluit enacts Bylaw No. 944 Impounded Vehicle and Equipment bylaw.
Traffic Safety Amendment bylaw No. 943 includes an increase in the penalty for passing or overtaking a school bus that is loading or unloading children within the municipality while the stop sign and or combination of flashing red lights engaged. The penalty has increased to $1000.00.
The bylaw also addresses motorists who:
“Stops the motor vehicle on a roadway in a manner that impedes or obstructs the flow of traffic, where no traffic control device is located requiring the vehicle to stop or yield”.
To simplify the above, any motorist who stops, interrupts and holds traffic, attempts to direct traffic or allow traffic commuting in any direction not having the right-of-way to enter in or leave traffic is in contravention of section 2.18 and subject to a penalty of $200.00.
The amendment also includes penalties for vehicles in the opinion of an enforcement officer to be in an “unsafe condition”. This includes but is not limited to vehicles not equipped with bumpers, bumper height, window glass, headlights and taillights.
Penalties for towing conveyance, not having the required fully functional trailer lights and trailer breaking system that are in contravention of this bylaw as well as the Territorial Traffic Safety Act, and vehicles not equipped with all standard mandatory equipment under the Territorial Motor Vehicle Equipment Standards are subject to penalties and possible impoundment.
The amendment gives additional powers to enforcement officers for the impoundment of vehicles for contraventions under bylaw No. 943, where in the opinion of a Peace Officer, may impound a vehicle in contravention of any section herein of this bylaw in order to prevent the continuation of the offence.
The City has subsequently enacted the Impounded Vehicle and Equipment Bylaw No. 944.
